Lets make sure we understand the sequence of events leading up to negotiations about repair costs.
1. The Buyer tours homes until he or she finds one he wants to buy
 
2. In most states, the Buyer makes a formal Offer to Purchase the house, usually:
  • At a price somewhat lower than the the Seller's asking price.
  • With requirements that Seller pay for repair of general items such as the roof if subsequently found to have leaks.
 
3. Seller and Buyer agree on price and terms and sign a Sales Contract.
 
4. Inspectors working for the Buyer examine the property and list defects that need to be repaired.
 
5. Buyer and Seller haggle over what defects must be repaired by the Seller
  • The seller must repair items specified in the Contract or Agreement
  • Other defects found by inspectors are open for negotiations.
